Materiales periodísticos de revista vanguardia aún están secuestrados
La revista Vanguardia, que el pasado 17 de diciembre de 2010 sufrió el secuestro de sus computadores dónde estaban materiales periodísticos sensibles continúa sin poder recuperar su material de trabajo, ni la información necesaria para seguir operando, pese a que su abogado, Gerardo Aguirre, señaló que "ya han saldado la totalidad de sus deudas".
Pedro Delgado, presidente del fideicomiso AGD-CFN "No más impunidad" aseguró, en entrevista a la agencia de noticiasestatal Andes, que Vanguardia no había pagado absolutamente nada. "No sé a quién pagarían esa plata, pero al Gobierno no lo han hecho", dijo. Sin embargo, Aguirre afirmó que la deuda se pagó en su totalidad en los Juzgados Primero, Segundo y Tercero de Inquilinato y dijo no entender el por qué de las afirmaciones de Delgado. "Si ya no quieren ir al juzgado a retirar el dinero, es otra cosa...", dijo Aguirre.
Luego de 21 días de incertidumbre y tras tres intentos fallidos de obtener, al menos, las copias de la información contenida en los discos duros de 25 computadoras de la revista, Vanguardia sigue a la espera de que los funcionarios del Fideicomiso AGD-CFN "No más impunidad" les den una respuesta.
Hace dos semanas, el Juez Primero de Garantías Penales del Guayas, Ángel Rubio dictó una orden para que el personal de la revista pueda sacar un respaldo de la información periodística contenida en los discos. Sin embargo, esta orden se incumplió por tres ocasiones porque al depositario judicial, Paúl Andrés Cabezas, "no se lo notificó".
Aguirre confirmó a Fundamedios que están gestionando para que el juez emita una nueva orden para recuperar la información, aunque aseguró que, lo que esperan es que el juez de coactivas levante todas las medidas y disponga, ya no solamente que se entregue la copia de la información, sino la devolución inmediata de todos los equipos que fueron secuestrados, puesto que ya han saldado sus deudas.
"No nos entregan porque no les da la gana, para que vea que el pretexto no eran los arrendamientos, el pretexto realmente es el secuestro de la información", dijo Aguirre.
Por su parte, el director de la revista Juan Carlos Calderón aseguró que continúan laborando, pero con dificultades puesto que no cuentan con la memoria gráfica ni documental del trabajo periodístico de la revista.
Respecto al problema de inquilinato Calderón aseguró que la editorial tiene toda la voluntad para dar salida al problema y ya ha saldado sus deudas. Sin embargo, este director cree que "se ha demostrado claramente que la intención no era saldar un problema de inquilinato, sino estorbar el trabajo de Vanguardia"

Vanguardia magazine is still not able to recover the computers seized on 17 December 2010. The computers are still being retained even though the magazine"s lawyer, Gerardo Aguirre, has pointed out that "they have paid off all their debts".
Pedro Delgado affirmed during an interview with state owned news agency Andes that Vanguardia has paid absolutely nothing. "I don"t know who they have paid that money to, but not to the government", he said. However, Aguirre confirmed that the debt was fully paid in the Courts and said he did not understand why the claims of Delgado. "If they don"t want to go to court to withdraw the money, it´s their problem ..." said Aguirre.
After 21 days living in uncertainty and three failed attempts to obtain at least copies of the information contained in the hard disks of the magazine"s 25 computers, Vanguardia continues waiting for an answer from the AGD-CFN Trust "No more impunity" officials.
Two weeks ago, Guayas" 1st Criminal Magistrate Judge, Ángel Rubio, issued an order allowing magazine personnel to make back-ups of the journalistic material contained in the hard-drives. However, this order was not complied with in three occasions because the administrative receiver, Paúl Andrés Cabezas, "was not notified".
Aguirre confirmed to Fundamedios that they are taking steps towards obtaining a new order from the judge so that the information can be recovered, although he declared that what they are really hoping for is that the collections court judge will suspend all measures and determine that not only copy of the information must be handed over, but that all the equipment should be immediately returned in view that the magazine has paid off all its debts.
"They are not returning it because they just don"t feel like it; the reason is not the payment of the rent, the real reason is retaining the information", said Aguirre.
The magazine"s chief editor, Juan Carlos Calderón, stated that they are continuing to work despite the difficulties caused by the lack of the archives.
Regarding the lease related problem, Calderón assured that the editorial has the will to solve the problem and that it has paid off its debts. He believes, however, that it "has been clearly shown that the intention was not to solve a lease related problem, but to hinder Vanguardia"s work".
